What You Should Know About The Pregnant Workers Fairness Act

WHAT is it? The Pregnant Workers Fairness Act is a new law that goes into effect June 27, 2023 that requires covered employers to provide reasonable accommodations to a worker's known limitations related to pregnancy, childbirth, or related medical conditions, unless the accommodation will cause the employer undue hardship.

It applies only to accommodations, not to discrimination. Existing laws (www.eeoc.gov/pregnancy-discrimination) that make it illegal to fire or otherwise discriminate against workers on the basis of pregnancy, childbirth, or associated medical conditions.  

More than 30 states and cities have laws that provide accommodations for pregnant workers, and the PWFA does not replace any law that is more protective in nature.
